CMS issued corrections to the Final FFY 2012 rules on February 1, 2012.  The changes were very minor in nature.

This document corrects technical errors that occurred in the Addendum of the final rule entitled “Medicare Program; Hospital Inpatient Prospective Payment Systems for Acute Care Hospitals and the Long-Term Care Hospital Prospective Payment System and Fiscal Year 2012 Rates” which appeared in the August 18, 2011 Federal Register.

SNF PPS Final Rule Correction – FFY 2012

Corrections were issued by CMS on September 26, 2011 for the original final SNF PPS rules that were released on August 8, 2011.  There were omissions that impacted the wage index values for Dothan, AL (CBSA 20020), Monroe, LA (CBSA 33740) in Table A and the Statewide wage index for Louisiana (19) in Table B.  Click here to locate the download link containing the updated table identified as “CMS 1351-CN Wage Index Tables for FY 2012 [ZIP, 83KB]”.

Inpatient Rehab PPS Final Rule Correction – FFY 2012

Corrections were issued by CMS on September 26, 2011 for the original final IP Rehab PPS rules that were released on August 5, 2011.  These corrections are significant and required the re-issuance of the payments in Table 11.  The September 26, 2011 corrected federal register includes the corrected payment rates effective October 1, 2011.

Inpatient PPS Final Rule Correction – FFY 2012

Corrections were issued by CMS on September 26, 2011 associated with the August 18th 2011 final PPS rules for FFY 2012.  The changes were mostly spelling errors.  However there were some corrections that impacted the wage table information.  CMS published an updated spreadsheet table containing tabs with a “CN” designation where changes were made impacting specific hospitals or CBSAs.  Providers in Louisiana were primarily impacted by this correction.  I have downloaded the updated wage index file for FY 2012.  Click here to view the updated spreadsheet.

CMS recently became aware of errors that were made in the May 5, 2011 Inpatient PPS proposed rules. Specifically there was a calculation error made impacting 104 providers that will now be eligible to receive the outmigration adjustment (Table 4J). This correction however could impact providers’ decisions relative to withdrawing wage index reclassifications as a result of the outmigration factor. CMS therefore is allowing the impacted hospitals an additional 7 days to make a decision relative to withdrawing a geographic reclassification request. I have included the text of their decision below:

The Centers for Medicare & Medicaid Services (CMS) has recently become aware of an error in the calculation for the outmigration adjustment in the May 5, 2011, Inpatient Prospective Payment System (IPPS) proposed rule. This error in the calculation affects 104 providers that will now be eligible to receive the outmigration adjustment. Since these changes could affect hospitals’ geographic reclassification decisions, it is important for hospitals to be notified of the changes to Tables 2 and 4J of the FY 2012 IPPS/LTCH PPS proposed rule. A correction notice will be published. Hospitals can download the letter and revised tables below for more information.

In addition, under our authority in section 1886(d)(10)(D)(v) to establish procedures under which a subsection (d) hospital may elect to terminate a reclassification, we are creating a special procedural rule, limited to FY 2012. Under this procedural rule, we will extend the 45-day deadline of Section 412.273 (referenced at 75 FR 25881) for hospitals to terminate or withdraw 1886(d)(10) reclassifications as well as the 45-day deadline (referenced at 75 FR 25887) for a hospital to receive the out-migration adjustment rather than their section 1886(d)(8)(B) redesignation. We will allow hospitals a 7-day period from the date of display of the Federal Register Correction Notice in which hospitals may choose to revise the withdrawal/termination decisions referenced above for FY 2012. The Correction Notice will be posted on the CMS Web site at http://www.cms.gov/AcuteInpatientPPS/IPPS2012/itemdetail.asp.

Revision to Formula to Compute the Time Value of Money

This transmittal involves a technical correction to the formula used to compute the Time Value of Money when Medicare contractors perform outlier reconciliation under the IPPS, IRF PPS, LTCH PPS, IPF PPS and OPPS.

Excerpt from Transmittal:

A. Background: The IPPS, IRF PPS, LTCH PPS, IPF PPS and OPPS all have similar regulations concerning outlier reconciliation which are effective on different dates and discussed in full detail in the policy section below. In change request 7192, transmittal 2111, dated December 3, 2010, CMS inadvertently set the formula used to compute the Time Value of Money by dividing the rate from the Social Security Web site by the number of days in the cost report. The corrected formula should divide the rate from the Social Security Web site by 365 in order to compute a daily rate.

Correction Notice CMS-1518-CN – FY 2012 IPPS Proposed Rules

CMS released corrections to the FY 2012 IPPS proposed rules on June 14th. The corrections were minor involving typographical errors. There were no corrections to any of the payment rates or table content made in this correction notice.

Because of an error in the calculation of the Home Health Prospective Payment System (HH PPS) 10 percent outlier limitation, the basic calculation of the outlier limitation since January 1, 2010, has been incorrect. As a result, your payment for Medicare home health services in 2010 may be incorrect.
